Permanent Position – Executive Level

This position reports to the CEO and is required to lead and direct the Legal Department so that Regulator, Compliance and Tribunal functions adhere to the National Ports Act and related directives and regulations, the Ports Regulator complies with all governing legislation (PFMA, National Ports Act etc.), and that sound legal advice is provided to the Ports Regulator and Minister of Transport in matters pertaining to Ports and the management and administration of the Ports Regulator. The successful applicant will be an Admitted Attorney/ Advocate with at least 10 years’ experience in the field of Commercial or Administrative Law. Experience in Constitutional and/or Contract law would be an advantage. Exposure to the public sector would be desirable.

Position purpose:

  • Oversight of the Regulatory and Compliance function as well as the Tribunal function of the Regulator
  • Manage an effective and efficient corporate legal function within the Ports Regulator
  • Assist in preparing the annual departmental budget

The successful candidate must:

  • Have an LLB degree (A Post graduate qualification will be an advantage)
  • Admission as an Attorney/Advocate with the Law Society of South Africa
  • A minimum of 8 to 10 years post admission experience
  • A minimum of 7 years of management experience of which 3 years should have been at senior management level
  • The incumbent should possess leadership, people management, and good interpersonal skills, with the ability to engage with other Directorates, Executives and Regulator Members
  • An understanding of strategic, operational and risk identification and risk management
  • Knowledge of governance best practices
  • In-depth knowledge of applicable legislation, regulations and frameworks
  • Knowledge of Legal research methodologies and practices
  • An understanding of maritime legislation and litigation
  • Previous litigation experience essential

Position Outputs:

  • Ensure that the entire Legal department is operating effectively
  • Oversight of the Regulatory and Compliance function as well as the Tribunal function of the Regulator
  • Minimisation of risk of Administrative Action for the organisation
  • Review and drafting of commercial contracts for the organisation
  • Provide general legal support to the organisation
  • Oversight of the Company Secretary function in the organisation
